Who is the Promoter of the Competition?

The Promoter in Australia and New Zealand is Bega Cheese Limited (ABN 81 008 358 503), 23 Ridge Street, North Bega NSW 2550. Phone: 1800 571 833.

When will the Competition start and end?

The Competition starts at 12.01am (AEDT) on 01/11/2018 (which is 2.01am (NZDT) on 01/11/2018) and ends at 9.59pm (AEDT) on 03/01/2019 (which is 11.59pm (NZDT) on 03/01/2019) (the Competition Period).

No entries received outside of the Competition Period will be accepted.

The time of entry is the time that the entry is received by the Promoter and not the time of transmission by the entrant.

Who can enter?

Entry is only open to Australian and New Zealand residents aged 18 or over as at the commencement of the Competition Period who can take the trip prize on dates to be specified by the Promoter between 14/01/2019 and 20/01/2019 (inclusive).

Who can't enter?

Entry is not available to directors, officers, management and employees of:

  1. the Promoter; or
  2. the agencies or companies associated with this Competition,

and their immediate families.

Where will the Competition run?

The Competition will run in stores which are stocking VEGEMITE products in Australia and New Zealand (Store).

Do I need to buy anything to enter?

Yes. During the Competition Period, you need to buy any VEGEMITE product (Qualifying Purchase) from a participating Store (includes online purchases) and retain your receipt as proof of purchase.

Entry instructions

After you have made a Qualifying Purchase, you must during the Competition Period, visit www.vegemite.com.au/promo (Website) and fill out and submit the online entry form, including by uploading an image of the Qualifying Purchase receipt and all other requested information.

All valid entries will be entered into all subsequent daily prize draws, and into the trip prize draw for your country of residence.

Purchase receipts must clearly identify the Store of purchase (which must be a participating Store), the product(s) purchased (which must be a Qualifying Purchase), and the date of purchase (which must be during the Competition Period) before you submitted your entry.

How many winners will there be and how will they be chosen?

There will be a total of up to 322 winners determined in respect of this Competition – 320 daily winners, 1 Australian (AU) trip prize winner and 1 New Zealand (NZ) trip prize winner.

For the avoidance of doubt, a daily winner may also win a trip prize.

AU trip prize

All valid entries received during Competition Period, including any previous daily prize winners, will be entered into the AU trip prize draw.

The AU trip prize draw will be held at 11am (AEDT) on 07/01/2019 at Immediate, 191 Ferrars Street, Southbank VIC 3006 (Immediate). The first valid entry drawn randomly in this draw will win the AU trip prize.

NZ trip prize

All valid entries received during the Competition Period, including any previous daily prize winners, will be entered into the NZ trip prize draw.

The NZ trip prize draw will be held at 11am (AEDT) (which is 1pm (NZDT)) on 07/01/2019 at the Immediate office. The first valid entry drawn randomly in this draw will win the NZ trip prize.

Daily prizes

All valid entries received during the Competition Period will be entered into the daily draw for that day.

There will be 64 daily draws; 1 in respect of each AEDT day of the Competition Period. The draw for each day will occur at 11am (AEDT) (which is 1pm (NZDT) on the next business day following each day of the Competition Period).
Draws scheduled for a Monday will determine the winners for the previous Friday, Saturday and Sunday. Draws scheduled for the day following a Victorian public holiday will determine the winners for that public holiday. All draws will take place at Immediate.

The first 5 valid entries drawn randomly in each daily draw from the entries received to date during the Competition Period will each win a daily prize.

In all draws, the Promoter may draw additional reserve entries and record them in order, in case a winning entry/entrant is deemed invalid, or a prize is unclaimed (Reserve Entrants).

What can I win?

There are in total 322 prizes available – 1 AU trip prize, 1 NZ trip prize and 320 daily prizes.

AU trip prize

The AU trip prize is a trip for the winner and 3 additional friends or family members (up to 4 people total, with a maximum of 2 children) to the 2019 Australian Open, valued at up to AUD $10,000 depending on the winner's point of departure.

NZ trip prize

The NZ trip prize is a trip for the winner and 3 additional friends or family members (up to 4 people total, with a maximum of 2 children) to the 2019 Australian Open, valued at up to NZD $11,623.96 depending on the winner's point of departure.

Daily prize

Each daily prize is a Vegemite prize pack, consisting of selected merchandise as specified by the Promoter valued at AUD $50 (approximately NZD $58.11).

There is a limit of one daily prize per person, except for South Australian residents.

Total prize pool

The total maximum prize pool in AUD is up to $26,000. The total maximum prize pool in NZD is up to $30,219.16.

How many times can I enter?

You can enter up to five times per day, provided you only enter once per Qualifying Purchase. Each entry must be submitted separately in accordance with these Terms and Conditions.

How and when will the winners be informed?

If you are a winner of a daily prize, you will be informed by phone and in writing, to the email address provided by you at the time of completing your entry, within two days of the relevant draw.

If you are a trip prize winner, you will be informed by phone and in writing, to the email address provided by you at the time of completing your entry, within two days of the relevant draw and your name and state/territory of residence will be published on the Website on 08/01/2019 for a period of 28 days.

Must I keep anything to verify my entry?

You must keep the original itemised purchase receipt(s) for each Qualifying Purchase used to enter the Competition as proof of purchase. The Promoter may request you to provide the original itemised purchase receipt before awarding the prize.

If you don't produce the proof of purchase for all Qualifying Purchases when asked, the Promoter may disqualify all of your entries and you will lose any right to a prize. Purchase receipt(s) must be identical to the image uploaded by you with your entry.

If, in the Promoter's opinion, you have shared any receipt(s) with another person, your entries will be invalid and you will lose any right to a prize.

Verification Requirements

If requested by the Promoter, prize winners may be required to provide proof of identity, proof of age and proof of residency to verify their identity (Proof of Identity).

Identification considered suitable for verification is at the Promoter's discretion. Failure to provide Proof of Identity on request and in the form required by the Promoter may result in an entrant's entries being deemed invalid, at the Promoter's discretion.

Entering under a false name may invalidate entries. Multiple entries under different names and/or different emails from the same residential address may also invalidate all such entries, at the Promoter's discretion, unless Proof of Identity (for all such entries submitted during the Competition Period) are produced on request.

If I win, how and when must I claim my prize?

The AU trip prize winner must claim their prize by responding to the Promoter by 5pm (AEDT) on 10/01/2019.

The NZ trip prize winner must claim their prize by responding to the Promoter by 7pm (NZDT) on 10/01/2019.

Daily prize winners must claim their prize by responding to the Promoter by 5pm (AEST) (which is 7pm (NZDT)) on 04/04/2019.

If a prize winner complies with the conditions of entry and the Promoter verifies and accepts the entry, the prize will be delivered to each winner by email or by post to the address provided to the Promoter at the time of completing their Competition entry or as part of the Verification Requirements.

The Promoter takes no responsibility for an incorrect address being provided by an entrant. Once dispatched, the Promoter is not liable for any prize that has been lost, stolen, damaged or tampered with in any way.

What if I don't claim my prize on time?

Trip prize

If a trip prize has not been accepted or claimed by the relevant trip prize claim date and time above or if, after making all reasonable attempts, the Promoter cannot contact the drawn winner (or the drawn winner does not contact the Promoter) by this time and date, the relevant entry will be discarded and the Promoter will re-award the relevant prize to a Reserve Entrant from the respective original pool of entries and/or carry out an unclaimed prize draw at 11am (AEDT) (which is 1pm NDZT)) on 11/01/2019 at the same location as the original draw/s to distribute the relevant prize/s. Any such winner will be informed by phone and in writing within two days of determination and their name and state/territory of residence will be published on the Website on 14/01/2019 for a period of 28 days.

Daily prize

If a daily prize has not been accepted or claimed by the daily prize claim date and time above or if, after making all reasonable attempts, the Promoter cannot contact a drawn winner (or a drawn winner does not contact the Promoter) by this time and date, the relevant entry will be discarded and the Promoter will re-award the relevant daily prize/s to Reserve Entrant/s and/or carry out an unclaimed prize draw at 11am (AEST) (which is 1pm (NZDT)) on 05/04/2019 at the same location as the original draw/s to distribute the relevant prize/s. Any such winner/s will be informed by phone and in writing within two days of determination.

  1. These Terms and Conditions incorporate and must be read together with the details outlined in the table above. Information about prizes and how to enter forms part of these Terms and Conditions. The above table prevails, to the extent of any inconsistency with the Terms and Conditions. By entering the Competition, you accept these Terms and Conditions.

Entry

  1. Your entry must be received during the Competition Period in accordance with the details set out in the table above. Your entry is deemed to be received only when received by the Promoter's database. If you return a Qualifying Purchase your entry may be deemed invalid at the Promoter's discretion (unless product is defective). You will receive a return online message confirming your entry. The Promoter is not liable for any problems with communications networks. You are responsible for your own costs associated with entering. If you enter using automatically generated entries or multiple aliases you may be disqualified.

Prizes

  1. If you win a trip prize, your prize will be a trip for you and 3 friends or family members (up to 4 people total, with a maximum of 2 children) to Melbourne, Victoria, Australia on dates to be specified by the Promoter between 14/01/2019 and 20/01/2019 (inclusive) and includes:
    1. return economy airfares (including airfare taxes) for you and your family (or friends) from your nearest Australian or New Zealand capital city to Melbourne (flights are not included if the winner lives in Victoria, Australia, and if so, the winner and their family (or friends) must make their own way to and from the hotel at their own cost);
    2. 2 nights' accommodation in a minimum four star hotel (as determined by the Promoter) for you and your family (or friends);
    3. return transfers between the airport and hotel for you and your family (or friends) (not included if flights are not included in accordance with (a) above);
    4. a meal at the Rockpool Restaurant for you and your family (or friends) to the value of $800 AUD;
    5. tickets to a match (to be specified by the Promoter) at the 2019 Australian Open for you and your family (or friends);
    6. a behind the scenes tour of the 2019 Australian Open for you and your family (or friends); and
    7. $500 AUD spending money for you.

    Accommodation, activities and flights are subject to booking and availability. The prize must be taken on dates to be specified by the Promoter between 14/01/2019 and 20/01/2019 (inclusive) to coincide with the 2019 Australian Open event. You and your family members (or friends) are responsible for all other costs related to the prize, including any additional meals, additional transfer costs, insurance (including excesses), in-room charges and additional taxes. All persons taking the prize must depart and return at the same time. The prize is subject to any additional conditions of the prize supplier/s including any conditions of travel and conditions of entry into the 2019 Australian Open (including behaviour requirements and applicable dress codes). Costs for changes made by you (or your family members or friends) to the prize after it has been booked must be paid by you and your family or friends as applicable. If relevant, you and your family or friends must ensure that you have all necessary documents to travel to Melbourne, Australia, including a current and valid passport and any visas required. If a person taking the trip is under 18 years old at the date of departure they must be accompanied by their parent or guardian at all times. You may be required to present your credit card when checking in to the accommodation.

  2. Each trip prize must be taken on the date and time and at the location of the 2019 Australian Open event as advised by the Promoter, to which you have won tickets. Any failure by you or your family or friends to comply with the conditions imposed by the prize supplier(s) may result in the prize being cancelled or withdrawn without liability for the Promoter or the prize supplier(s). Tickets can only be used once and will be deemed invalid if copied. The Promoter does not control entry to the relevant event location. You must keep your tickets safe and the Promoter will not replace lost or stolen tickets.
  3. If the value of the meal at Rockpool Restaurant consumed as part of the prize is less than the value specified by the Promoter, the balance will not be provided to you and no cash or other prize will be provided in its place. Any costs incurred over the specified value must be paid by you and your family or friends.
  4. If an event or activity included in the trip prize is abandoned, called off or postponed for any reason, you and your family or friends forfeit your entitlement to that prize element and you will not be given any cash or alternative tickets as a substitute for attending the event or activity. You will still receive all other components of the prize as long as they are still taken on the original dates.

General

  1. If you are a winner, you (and your family or friends) must take part in all publicity, photography and other promotional activity as the Promoter requires, without any compensation. You consent (on your behalf and on behalf of your family or friends) to the Promoter using your names and images in any promotional or advertising activity in accordance with these Competition Terms and Conditions. If a winner's family or friends includes children under 18 years of age, the winner will be required to provide consent to participation in the promotional activities on the child's behalf.
  2. If you or your entry are deemed by the Promoter to breach these Terms and Conditions including if you are unable to take the prize on the dates specified between 14/01/2019 and 20/01/2019, your entry (or at the Promoter's discretion, all of your entries) may be discarded. The Promoter may, at any time, require you to produce documentation to establish to the Promoter's satisfaction the validity of your entries and your ability to comply with these Terms and Conditions (including documentation establishing your identity, age, place of residence, place of employment and right to travel to Melbourne, Australia). Failure by the Promoter to enforce any of its rights at any stage does not waive those rights.
  3. You must not:
    1. tamper with the entry process;
    2. engage in any conduct that may jeopardise the fair and proper conduct of the Competition;
    3. act in a disruptive, annoying, threatening, abusive or harassing manner;
    4. do anything that may diminish the good name or reputation of the Promoter or any of its related entities or of the agencies or companies associated with this Competition;
    5. breach any law; or
    6. behave in a way that is otherwise inappropriate.
  4. You are responsible for your family or friends and the Promoter may disqualify all entries from, and prohibit further participation in this Competition by, you or any or all of your family or friends if any of them breach these conditions, whether or not legally bound by them.
  5. If you (or your family or friends, if applicable), in the opinion of the Promoter (and/or a medical professional, as required), are intoxicated, under the influence of alcohol or any other drug, behave aggressively or offensively, or behave in a manner which may diminish the good name or reputation of the Promoter or any of its related entities or the agencies or companies associated with this Competition, is contrary to law or is otherwise inappropriate, the Promoter may cancel the prize or restrict you (and your family and friends) from participating in any elements of the prize, at its discretion.
  6. The Promoter is not liable for entries, prize claims or correspondence that are misplaced, misdirected, delayed, lost, incomplete, illegible or incorrectly submitted.
  7. The Promoter's decision in connection with all aspects of this Competition is final.
  8. Prizes cannot be transferred or exchanged nor (except where cash is specified) redeemed for cash. Without limiting any other term of these Terms and Conditions, all prizes (and elements of prizes) must be taken as and when specified, or will be forfeited with no replacement. The prize values are correct as at the date of preparing these Terms and Conditions and include any applicable GST. The Promoter is not responsible for any change in prize value. You agree that if a prize (or element of a prize) is unavailable for any reason the Promoter may provide another item of equal or higher value, subject to any necessary approval by the state/territory gaming authorities.
  9. By entering, you request that your full address not be published.
  10. By accepting or participating in any prize, your family and friends accept these Terms and Conditions.
  11. If this Competition cannot run as planned for any reason beyond the Promoter's control, for example due to software, hardware or communications issues, unauthorised intervention, tampering, fraud or technical failure, the Promoter may end, change, suspend or cancel the Competition or disqualify affected entries/entrants, subject to any necessary approval by the state/territory gaming authorities. Where it is practical for it to do so, the Promoter will notify you of such changes.
  12. The Promoter is not responsible for any tax implications arising from you winning a prize. You should seek independent financial advice. If for GST purposes this Competition results in any supply being made for non-monetary consideration, you must follow the Australian Taxation Office's stated view that where the parties are at arm's length, goods and services exchanged are of equal GST inclusive market values.

Liability

  1. Nothing in these Terms and Conditions restricts, excludes or modifies any consumer rights under any statute including the Australian Competition and Consumer Act 2010 (Cth) and the New Zealand Consumer Guarantees Act 1993).
  2. Subject to the previous paragraph, the Promoter and the agencies and companies associated with this Competition are not liable (including in negligence) for any loss (including indirect, special or consequential loss or loss of profits), expense, damage, personal injury, illness or death suffered in connection with this Competition or any prize, except for any liability which under statute cannot be excluded (in which case that liability is limited to the greatest extent allowed by law).
  3. Without limiting the previous paragraph, the Promoter and the agencies and companies associated with this Competition are not liable for any loss of, damage to or delay in delivery of prizes. Prizes will only be delivered to addresses in Australia or New Zealand.
  4. The Promoter may communicate or advertise this Competition using Facebook or Instagram. However, the Competition is in no way sponsored, endorsed or administered by, or associated with, Facebook or Instagram. You provide your information to the Promoter and not to Facebook or Instagram. You release Facebook and its associated companies from any and all liability arising from any aspect of the Competition.

Collection and use of your personal information

  1. The Promoter may collect your and your family and friends' personal information directly or through its agents or contractors. Entry into the competition/acceptance of a prize is conditional upon you providing the requested information and by entering this competition and/or accepting a prize you consent to the use of your personal information as described below. The Promoter will use your and your family/friends' personal information only for the purposes of conducting the Competition and, where relevant, organising the trip prize. The Promoter may disclose your and your family/friends' personal information to its related companies, agents and contractors to assist in conducting this Competition, communicating with you or your family or friends or storing data. This may include disclosures to organisations outside Australia including in places such as New Zealand. By entering, you consent to the Promoter keeping your personal information on its database to use for future marketing purposes, including contacting you by electronic messaging and you confirm that each of your family members or friends (as applicable) have provided their consent to the collection, use and disclosure of their personal information in accordance with these Terms and Conditions and the Promoter's Privacy Policy.
  2. Entrants' personal information will be used, held and disclosed by the Promoter in accordance with the Promoter's Privacy Policy (see https://vegemite.com.au/privacy-policy/), which includes information about:
    1. how to seek access to the personal information the Promoter holds about you and seek correction of the information; and
    2. how to complain about a privacy breach and how the Promoter will deal with such a complaint.
